Should I be wary of a roofer that starts talking "insurance claim" before he even looks at the job?

I called a local roofer and the first thing he asked if the roof damage was storm related. I responded that I couldn’t be sure, nor could I prove it. Even though there were high winds over the weekend, the shingles may have just fallen off because of normal age deterioration, and the wind was just a catalyst. He asked for the name of my homeowner’s insurance agent saying he’d look at the roof and maybe he and the agent could "work something out." Now if I get pinched submitting a fraudulent claim, it’s my neck on the line, not his. What should I do?

More often than not your insurance company will assign an adjuster to the loss. The adjuster will be the one who determines the cause of loss, not the roofer. You, however, should be the one who talks to your agent. Don’t let the roofer take any liberties by acting as your representative to your insurance company,……he’s just a salesman/ roof installer. If you have had a significant wind storm or other covered cause of loss you normally have a year to file a claim depending on what state you’re in. If insurance approves the roof replacement under your policy you shouldn’t have to worry about a fraudulent claim because they wont pay for it if it isn’t covered. You are correct in stating that normal age and deterioration is not covered by insurance policies.

Is it better to file home insurance claims seperate or just one claim?

My home sustained some damaged due to a snow fall back in december. I didn’t file a claim back then and now that I got some shingles damaged due to strong wind i would like to file a claim. I was told that i might need to file 2 seperate claims. Would it make a big difference if i put it all under just one claim instead of filing 2 seperate ones?

If the insurance company knows about the snow damage and the fact that it wasn’t fixed they may not pay for the wind damage. This is because you didn’t take due diligence to repair the original damage. They may deny the claim completely or they may limit the amount of the claim.

Depends on the ‘claims basis’ of the policy. On an occurrence basis policy, any claims that occurred during the policy while the policy was active, will be honored.

someones trampoline damaged our car when a very high wind occurred are the owners of the trampoline responsible to turn a claim with there insurance company?

That will only be covered by the comprehensive coverage of your auto insurance. Im sure that isn’t the answer you want to hear, but I had the very same experience. The homeowner’s insurance said that they would not cover because the damage did not occur on their insured’s property. Whether the trampoline was tied down or not, that doesn’t matter.

Rental Business: Insurance Claim - How do I let a contractor know politely I’m not going to hire him?

Hi,
I am a landlord and have a rental business. Following a wind damage a contractor I called came and did some urgent work like cover roof temporarily etc. The insurance will pay him for that. However, there is more work to do and he provided a quote to do that too. I decided not to hire him because I learned the insurance is willing to pay me around $10,000 so I fix it myself or hire whoever I want to do it properly even if for less.
The contractor was nice to me and did come to the property a few times. How do I tell him my decision professionally without pissing him off?
I want at least to sound fair. I know I do not owe him anything but still I guess I did give him the impression he will do the other job as well. THANKS.

While he may be disappointed he didn’t get the bid, that’s part of the nature of his job.

Why are people so careless when the tree fell down to your car and home?

The strong wind knocked down my neighbor’s tree onto my car and part of my house. The neighbor across my house laughed out loud about it. My car was brand new. The owner of the tree did not want to take responsibility at all and he didn’t apologize to us. He told us to claim my own insurance. I said IF my tree fell down to your house/car, I’m responsible for it.
He said he didn’t not push the tree down so he was not at fault and not responsible. I called 911 four times and they refused to send me a police to make a police report. They said it wasn’t a criminal and it was mother nature. This is how I got the public service for being a good citizen and pay taxes. I called my insurance, they told me to get a police report.
Why people are so careless about this? Don’t they know that it could happen to them one day?
If one day it happened to them, they would feel what I feel.
I need your opinion.
It is mother nature ‘acts of God’ and it will happen to you one day no matter where you are, no matter how bad you are or how nice you are, how rich or poor, how smart or dumb, how old or young. It will happen to you one day. Do you understand?
It will happen to you in just a matter of time. No matter where you live or how safe you are. It will happen to you one day!

IS IT LEGAL for GMAC Mortgage Co to charge us insurance for last year that we didn’t know about ?

WE just got a letter telling us that for 2009/2010 we don’t have sufficient home/wind isurance and they will add it to our mortgage payment, doubling it, unless we pay them $6,000. My husband went immediately to our insurance agent, got the SAME COVERAGE for $3,000 and we thought that was that. Then we got the monthly mortgage that doubles our payments anyway and called !! We were told that this was to pay for the insurance for 2008/2009 that they, GMAC had written and paid for us - even though we didn’t know it, had no idea, and were never advised that according to GMAC, we didn’t have the insurance they want us to have for last year either. We made no claims on any insurance, obviously, we didn’t need to, but we also had no idea that GMAC had done this - if they really did.
I don’t think it’s legal, and it’s certainly not moral, for a mortgage company to write home insurance without the owner being advised and in agreement. We never were either of those. When we learned that GMAC wanted to charge that $ 6 thousand for this year, we went within 24 hours to our own agent and we would have done that exactly last year also, had we been advised of it.
I don’t believe this is legal . I have called an attorney and am waiting for a call on this issue but wonder if anybody else has ever heard of such a thing ! One mortgage company , NOT GMAC, told me that he’s been in the business for years and this sounds like a high class scheme to rip off the mortgage customers and that they can’t charge for last years insurance costs that the customer never took out or knew about.
I hope some body has some valid info to give me. I am also calling the State Insurance Comm. ’s office but WOW. This has us in shock. GMAC is demanding we pay $6,000 dollars in one lump sum right now or they are doubling our mortgage payments starting this month & we already received the statement with the doubled amount on it.
WE called and spoke with the Insurance dept and also Customer Service but the phone agents said over and over in one way or another that this is the way it is. We always thought GMAC was a reputable company but we don’t any more. Hope somebody has some good info for me. I wish I had the telephone to call our president but - oh, well. We don’t. WE could lose our house now on account of this.
Dana, we never were notified of any change, nor did we have any documents when the first mortgage co turned over/ sold our mortgage to GMAC. WE weren’t notified of anything until a year later.
There are NO documents for us to read, that’s the rub here. Nothing was ”re issued” ” re financed” ”NOTHING” and the mortgage just changed hands to GMAC.
GMAC didn’t decide until a year later, with no incidents and no claims of course, that since they wouldn’t get the 6 thousand for the coming year, then that they want it for the last year, already passed.
AS FAR AS WE KNEW, based on the entire last 2 years, we did have adequate insurance since no one had told us otherwise.
UNTIL ONE YEAR AFTER THE FACT ,

THAT IS, WHEN IT IS TOO LATE TO DO

ANYTHING ABOUT IT IN OUR FAVOR .

This is, I think, the illegal part.
Little 78, the terms of our mortgage were agreeable to us with the company we took it out with and were fine for 2 years until they sold the mortgage to another company, GMAC and no new ” terms” were made nor discussed doing that. There were no ”new terms” ever.
I give stars to anybody who answers my question just for the courtesy, unless of course they are mean or nasty. Thanks to all, I am interested in more answers from people with experience that I don’t have.

Well, I read that you weren’t advised that you didn’t have adequate insurance for 2008/09 until they advised you that you needed more insurance for 2009/10 also ? Am I reading this right ? And only then only when you went out to get your own insurance at half the cost ? Right there ? So they didn’t come up with this cost for 2008 until they found out that they couldn’t get you for the 2009 year. That really smells rotten to me !

It sounds to me that when they didn’t get you for the 2009 year that they went back to get you for the 2008 year, and that is just not legal to charge you now for insurance that didn’t happen then. They would have had to advise you at that time. Call your lawyer.
