my tree fell on my neighbors uninsured truck. will my insurance cover it if it was a sound tree or unsound?

wind storm. my insurance co will not cover it,they say his car insurance will . he has none. he is threatning suit. they will represent me in court but not small claims court but will provid e documents. they sent out an aborist if its found diseased and i lose can my insuarne co refuse to pay.if its found sound and i loose who will pay.what results could my finacial liability be ?state farm. i am sypathetic towards the neighbor and would like to see my insurance take care of it.what is my risk?

Unless you have wind insurance coverage, which now these pesky insurance companies have separated from the regular insurance, they won’t cover it.

If your neighbor did not have full insurance on his truck, then he’s SOL.

Damaged roof, insurance claim?

Forgive me but this is our first house. We had a hail storm that took off 40% of our shingles. We made an insurance claim. The adjuster included the roof damage (about 1450 sqft; it is an old roof 10 to 12 years, in sound shape during our purchase inspection, some minor hail damamge from previous storms, but sturdy) a fallen tree and damaged fence, and the trim on the outside of the house on the sides that the storm hit.

The adjuster evaluated the damage at $5300.00 After our deductable (2000) we are getting a check for a little over $400, and they are holding back $2900.

Q1. Does that mean that the estimated cost to repair (in their eyes) is roughly $5300 or less, or do they take what they estimate the repairs will cost, then depriciated them them to 5300? (we pay extra to have replacement cost value on our policy- does that apply to the roof).

Q2. If all of the repairs cost more than what the adjuster allocated, can we negotiate with the insurance company for the difference?

Q3. when do we get the holdback amount (i am assuming after we do the repairs and have a total cost).

I am going to call our agent, but she is out of the office until Wed.

Your adjuster or agent should explain this.

He’s guessing that the cost of the new roof would be around $5300. He’s depreciating that $5300 for age, then subtracting the deductible. Yes, replacement applies to the roof, BUT, you don’t get replacement, until AFTER the roof is replaced. So, after you replace the roof, you submit the paid receipt to the insurer, and they cut you an additional check for $$2900.

You get your quote for the roof repair from the contractor BEFORE they fix the roof - have them break out labor vs. materials. Then if the cost is MORE, you submit that quote to the insurance company, and ask them to contact the roofer of your choice to come to an agreed amount.

You get the holdback after repairs are completed.

Windows leaking in the rain?

We had a storm with hurricane force winds and tons of rain. The windows in my living room started leaking from the top. I thought of resealing them on the outside, but is there a way to be sure I don’t have any greater structural damage? I’m concerned there might be holes in the roof and/or water damage inside the wall.

Without further information - better still - a visual inspection, it is impossible to say.
If it’s just a matter of leaking between the glass and the frame then a blob of putty is probably all you need - but if they’re wooden frames, do check for any signs of rotting. If the wood is ok but the paint is a bit flaky, then sand it down and repaint with a good quality paint suitable for exterior wood.
If the water is entering between the frame and the brickwork it’s another matter altogether and you should seek professional advice. It may be the frame has rotted but if the window frames are ok, possibly there’s been some movement in the wall.
If it is coming through the wall itself you should check your guttering isn’t blocked and the downpipes are not broken. If it ’s left you will need to have walls re-plastered and completely redecorated, so get it seen to as soon as.
However, the best advice I can give is not to take advice from people who have no idea of your exact situation. If you think it’s more than a blob of putty and/or a coat of paint can fix, get in touch with a surveyor and start asking friends if they can recommend any builders, just in case.

Can the mortgage company just keep the insurance money?

I purchased a foreclosure on August 29th. After we had done a final walkthrough. Once we moved in we realized that there was hail damage to the roof from August 26th, (our new neighbors told us a hail storm came through) We had the roof checked out and sure enough the roof was damaged. (Not visible from the ground or at walkthrough) We contacted the Mortgage company’s insurance, they came out and assessed it and aproved a payment for repair. Now the mortgage company is refusing to pay, they are keeping the money to cover what they lost in the short sale on the foreclosure. Is this even legal?
I had an inspection prior to the hail storm. I did not know a hail storm had came through until I had moved in and found out from the neighbors. There was noone living in the house so the sellers were not aware of the storm either. During the walkthrough there was no way from the ground I could tell there was any damage to the roof. Even when up there recently I could not tell without the roofing inspector pointing out what the hail damage looks like.

They probably are not keeping it to cover what they lost. I really doubt this is legal. Most mortgage companies will hold the money for the job to be completed. Then they will pay. Also, if they held the insurance policy they can do what they want with the money. You bought "as-is".

Anyone dropped from State Farm Insurance (home) after filing claim?

We live in NY (Long Island) and recently came home from vacation to find a bad flood, caused by a washing machine hose which broke from wear and tear. There is damage, both upstairs and down. The washing machine is upstairs in the kitchen, and there was water in a few rooms which damaged carpeting and walls - not too horrible. The worst was downstairs where the water caused the ceilings to collapse in two rooms. Needless to say, this will wind up being a large claim. How nervous should we be about being dropped? State Farm is sending a second person to look at the damage, after receiving the estimates from the restoration company and flooring contractor, in order to approve the work. We have only had one other small claim, for a lost wedding band, 10 years ago. We have three other policies, in addition to our home insurance. Thank you for any advice you can give.

I use State Farm, they will not drop you.

They may question that the house is owner occupied though, that is a lot of damage that could only (logically) happen if no one was in the house.

Car insurance companies are legal theives! Where is someone to stand up for the little guy?

I have been with State Farm for years. I let them withdraw from my checking account over $300 dollars every month for coverage I agreed to. Now that we had to use our comprehensive coverage due to vandalism, they decide to reduce my coverage!!! They take your money but when you make a claim they punish you. Now they take a whole $6 less a month for our insurance but gave me a $500 deductable because of severe hail damage to my one vehicle & because someone decided to pour paint solvent on my new ‘07 Yaris while I was at a basketball game watching my daughter cheer. Who is out there standing up for us little guys who is charged through the nose for services & then punished when we need to use it!!! Who is out there standing up for us little guys when gasoline is falling a barrel, but now for any reason the idiots charge $2.50 a gal. of gas! I think I’ll through my hat in the ring & run for U.S. president. I would stand up for the little guy!!!

CowboyBil, No I don’t have 500,000 put away but I had never had to use my insurance before & after putting so much $ into insurance month after month it seems that my vehicle should be fixed when the situation calls for it. Your lack of communication skills shows when you refer to someone as a _____ whiner. I am also not a liberal but very much conservative. I am very tired of being taken to the cleaners. I do believe you are such a driver that you have had to put claims in for hugh amounts of damage you placed on others. I have never had an accident & if you read my question correctly you would have seen that I had hail damage & someone poured something on my vehicle. I was not the one who has ever had to use my insurance. Your lack of being able to let someone just vent shows that you lack something. If you only have time to sit & call people names you need to find something else to do… like get a life!

Are you sure you’re understanding what’s going with your policy?
Just because you file a claim they can not call you and say, "Oh we’re reducing your coverage." They have to abide by the the policy as it was ON the date of loss. Additionally, they can’t alter your policy without your express authorization. As for your deductible…that’s the amount you agreed to pay towards repairs before State Farm stepped and paid anything else. As for the $6 less….is it likely your premiums dropped? This does happen.

But then again, nothing State Farm does surprises me. They wrote me 2 renters policies, deducted the money out of my account monthly twice, and when I asked my agent about it…he told me I was nuts and to go elsewhere. Yet when I called the actual company, they discovered the error & immediately fixed it. I still dropped them….idiots.

Is it ok to apply a 2nd layer of roofing on a manufactured home (double wide)? ?

We have had some roof damage due to high winds this season and some shingles have blown off. We’ve had several estimates on work to fix our problem and he suggested applying a 2nd layer of roofing over our existing ones (and to put extra shingles where the ones have blown off). He was the only contractor to mention applying a 2nd layer of roofing. So I am just wondering if this would be ok to do on a manufactured home? Why didn’t anyone esle mention this? Were they all just trying to charge us extra?

it is ok to put a second layer on …but consider the shingles weigh about 240lbs a square its alot of weight for the rafters which are 2×2 in a double wide.the reason no one else suggested it is because they will make more money on a tear off usually about 30 to 40 dollars a square vers 13 to 15 for a re-roof .

I currently own a 2004 Chevy Malibu Classic that I am currently halfway through paying off. I have full coverage through progressive and the other night we had a hail storm but the hair wasnt very big so I didnt think it would hurt too much if any it was about pea to golf ball sized at biggest. Well the next morning my mom called me and asked if i had any damage to my car and told me to go look. When i did i found that there was quite a big of damage that you couldnt see in the bright sun when u look straight on but if u looked to the side you could see it there is alot of little dents all over the hood, the fenders, the roof, all four doors including the sides, and the trunk. I called to make a claim to my insurance company about this but i was wondering how much if anyone knows it might cost for the repairs. I have a 1000 deductable but im pretty sure there is enough damage that it will be a pretty high cost to fix I think my car is only worth about 6900 at the most so I’m thinking they might just total it out and call it a lost. But if anyone has had any experience with this please let me know how much u paid so i can have a better idea of what to expect? and i was also thinking about just keeping the payout to pay the rest of my car off instead of fixing it because i really dont mind the dents they dont look that bad any one want to give their opinion on that as to if that would be a good idea or not and why?

your insurance co. will have to look at it and give you an appraisal of how much it will cost to fix, anything other than that is just guessing and yes you can just keep the money they send you to fix it.
